No fundamental right To insist on particular route for religious procession: Allahabad High Court refuses plea seeking new Muharram Tazia route
Observing that the right to practise religion does not include a fundamental right to insist on a particular route for taking out a religious procession, the Allahabad High Court has refused to direct the Uttar Pradesh authorities to permit a Muharram Tazia procession through a newly proposed route in Sambhal district. The Court held that decisions regarding procession routes fall within the domain of the civil and police administration, particularly where issues of public order and communal harmony are involved.
