This new filing by the Defense in the Kohburger case tells us for the first time that there was a three person mixture of unknown DNA under fingernails of Maddie Mogen’s left hand. The defense is asking that this information be kept from the jury in Kohberger’s upcoming death penalty trial because jurors could believe the DNA is Kohburger’s and according to the defense, it is not.There are redactions in the document, but it does show there was preliminary testing done on the fingernail clippings and a “likelihood ratio” was calculated that proved to be inconclusive.According to the filing, the testing did provide a “likelihood ratio for Mr. Kohburger” from the analysis but any conclusion is redacted.According to the Defense motion the testing involved, a comparison of hypothesis “not a statement of identity or probability of identity.”Two hypothesis were looked at:“M.M., K.G., and one unknown unrelated person vs M.M. And two unrelated persons.”We do know that Mogan‘s best friend Kaylee Goncalves was laying next to her deceased on the bed at the Kings Road home on Sunday December 14, 2022 when authorities arrived.According to the filing the defense states they did independent lab testing that excluded Mr. Kohburger from the mixture.However, the defense admits this evidence was presented to a grand jury by prosecutors as they were seeking an indictment in early 2023. They also write “the state argued that the testimony was presented to the grand jury as exculpatory, and an effort to elicit favorable evidence for Mr. Kohberger. “At this point, the Prosecution has not filed a response by the to this defense motion.
